Terms of Use

Applies to: The AestheticMatch mobile application (the “App”).

These Terms of Use (“Terms”) are a binding agreement between you and Momentum Aksiyon Teknoloji Ltd. Şti. (“AestheticMatch,” “we,” “us,” “our”), which operates the App under the AestheticMatch brand, governing your use of the App. By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. By using the App you represent that you meet these requirements. The App is designed for adult users seeking cosmetic and self-care guidance.

2. What the App Is — and Isn't

AestheticMatch is an AI-powered aesthetic self-care and coaching app. It analyzes photos you take to generate an Aesthetic Score, builds a personalized routine, and provides guidance through an AI Coach, weekly Consults, and styling features.

The App is not a medical service or a diagnostic tool, and it does not provide medical advice.

3. Not Medical Advice

The Aesthetic Score, sub-metrics, Consults, Coach messages, and any product or routine suggestions are for informational and cosmetic purposes only and are not medical advice, diagnosis, or treatment. The AI Coach is not a doctor, dermatologist, or licensed professional. Always consult a qualified healthcare provider before acting on anything in the App, and especially for any medical concern (for example, a skin condition, reaction, or anything that may require treatment). Never disregard or delay professional medical advice because of something in the App.

4. AI-Generated Output

Scores, projections (for example, a “projected score in 6 weeks”), Consults, and Coach responses are generated by automated systems and may be inaccurate, incomplete, or not suited to your situation. They are estimates and guidance, not guarantees. We do not promise that your score will improve or that you will achieve any particular result.

5. Your Account

You access the App through a sign-in method (such as Sign in with Apple or Google). You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. Notify us of any unauthorized use.

6. Subscriptions, Billing & Auto-Renewal

The App offers auto-renewable subscriptions that unlock its features.

• Billing: payments are processed by Stripe through a secure checkout opened from the App, and your chosen payment method is charged upon confirmation of purchase. We do not receive or store your full payment card number.
• Auto-renewal: your subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your payment method is charged at the start of each renewal period.
• Free trials (if offered): if you don't cancel before a free trial ends, it automatically converts to a paid subscription. Any unused portion of a free trial is forfeited if you purchase a subscription.
• Managing/cancelling: you can manage or cancel your subscription at any time from the App (Profile → Subscription), which opens your Stripe billing portal. Cancelling stops future renewals; deleting the App does not cancel your subscription.
• Price changes: we may change prices; changes apply to future billing periods and, where required, only after notice and/or your consent.
• Refunds: refunds are handled by us in accordance with applicable law; contact support@aestheticmatch.com.
• Lapsed access: if your subscription lapses, your progress history becomes read-only and active features (Coach, check-ins, routine tracking) are paused until you resubscribe.

7. License & Acceptable Use

We grant you a limited, personal, non-transferable, non-commercial, revocable license to use the App. You agree not to:

• Misrepresent your identity, age, or eligibility.
• Reverse engineer, decompile, scrape, or attempt to extract our models or source data.
• Resell, rent, or commercially exploit the App or its output.
• Upload unlawful content, or photos of anyone other than yourself, or content you have no right to use.
• Interfere with, attack, or attempt to circumvent the App's security, scoring, or subscription controls.

We may suspend or terminate your access for violations.

8. Your Content & Photos

You retain ownership of the photos and content you provide. You grant us a limited license to host, process, and analyze them solely to operate the App and provide your scores, guidance, and timeline, as described in the Privacy Policy. Share cards you generate are watermarked; if you choose to share them, you are responsible for where and how you share.

9. Product Mentions

The Coach may name specific products when you ask. These are suggestions, not endorsements or medical recommendations, and in the current version are not paid placements or affiliate links.

10. Intellectual Property

The App, including its design, text, graphics, logos, scoring system, models, and the AestheticMatch brand, is owned by AestheticMatch or its licensors and is protected by law. Except for your own content, nothing in these Terms grants you rights to our intellectual property.

11. Apple App Store Additional Terms

These terms apply when you obtain the App from the Apple App Store:

• These Terms are between you and AestheticMatch only, not Apple. Apple is not responsible for the App or its content.
• Your license to use the App is limited to use on Apple-branded devices you own or control, per Apple's Usage Rules.
• Apple has no obligation to provide maintenance or support for the App. Direct support questions to support@aestheticmatch.com.
• To the extent permitted by law, Apple has no warranty obligation with respect to the App, and any warranty claims are our responsibility.
• Apple is not responsible for addressing your or any third party's claims relating to the App, including product-liability, legal/regulatory, or consumer-protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a U.S.-embargoed country or on a prohibited-party list, in compliance with applicable export laws.

12. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any score, projection, or result will be accurate or achieved.

13. Limitation of Liability

To the fullest extent permitted by law, AestheticMatch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the App or reliance on its output. Our total liability for any claim will not exceed the greater of the amount you paid us in the [12] months before the claim or [USD amount]. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to indemnify and hold AestheticMatch harmless from claims arising out of your misuse of the App, your content, or your violation of these Terms or applicable law.

15. Termination

You may stop using the App at any time and delete your account. We may suspend or terminate access for any breach of these Terms. Sections that by their nature should survive (for example, IP, disclaimers, limitation of liability) survive termination.

16. Dispute Resolution, Arbitration & Governing Law

Please read this section carefully. For users in the United States, it requires disputes to be resolved by individual arbitration and waives class actions and jury trials.

Informal resolution first. Before starting any formal proceeding, you agree to email support@aestheticmatch.com describing the dispute so we can try to resolve it in good faith. If it is not resolved within 30 days, either party may proceed as set out below.

Binding arbitration (U.S. residents). If you reside in the United States, you and AestheticMatch agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App, and not resolved informally, will be settled by binding individual arbitration rather than in court — except that either party may bring an individual claim in small-claims court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and the U.S. Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. Arbitration will take place in the U.S. county where you live or another mutually agreed location and may proceed by phone, video, or written submissions where the rules allow.

Class-action and jury-trial waiver. To the fullest extent permitted by law, you and AestheticMatch agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. You and AestheticMatch each waive any right to a jury trial. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

Your right to opt out. You may opt out of this arbitration and class-waiver agreement within 30 days of first accepting these Terms by emailing support@aestheticmatch.com with your name and a statement that you opt out of arbitration. If you opt out, the “Governing law and courts” provision below applies to your disputes instead.

Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and proceed in court; the rest of this section still applies.

Governing law and courts. These Terms, and any dispute not subject to arbitration, are governed by [substantive governing law — e.g. the laws of the State of New York, USA, for U.S. users], without regard to conflict-of-law rules. Except where the mandatory consumer-protection laws of your country or state of residence provide otherwise, the federal and state courts located in [venue, e.g. New York County, New York] (for U.S. users), or the courts and enforcement offices of İstanbul (Çağlayan), Türkiye (for users elsewhere), will have jurisdiction over disputes not resolved by arbitration. Nothing in this section removes any protection you have under mandatory consumer-protection laws that apply where you live.

17. Changes to These Terms

We may update these Terms. Continued use of the App after an update means you accept the revised Terms. Material changes will be surfaced in-app.
